  • Site Use:

    • You may terminate your use of our Site at any time. We may suspend, discontinue or terminate your access to or use of our site at any time immediately and without prior notice or obligation to you (i) if you violate any of the terms contained in these Terms & Conditions or our Code of Conduct as determined by A Nurse's Tea in its sole discretion, or (ii) for any other reason in A Nurse's Tea's sole discretion. We may notify you of any such suspension, discontinuance or termination by email to an email address you provided to us upon enrollment. Upon your receipt of such notice, you will immediately discontinue use of this Site during the period of suspension (for a suspension) or permanently (for a discontinuance or termination). You agree that A Nurse's Tea shall not be liable to you for any suspension, discontinuance, termination, change or modification of your use of or access to this Site.

  • User Profiles:

    • You must not allow any third party to access this Site using the email address you provided during the registration process ("Log-in ID") and password;

    • You are prohibited from using anyone else's Log-in ID and password to access this Site;

    • You are responsible for any use of this site by any third party who accesses the this Site using your Log-in ID and/or password;

    • You will notify A Nurse's Tea immediately if you suspect any unauthorized use of this Site or of your Log-in ID and/or password; and

    • You are responsible for ensuring that any information that you provide to A Nurse's Tea as part of the account registration process is accurate and is kept up to date at all times, and you will notify us immediately of any changes to this information.

    • If you abuse our service and purposefully lie to get free tea, as unfortunately some have in the past (which means other people get less tea), then we reserve the right to to remove your profile from our platform and strip away any Rewards Club benefits.

    • We reserve the right to refuse service to anyone who engages in malicious or abusive behavior, breaks our code of conduct, creates a decoy profile to get around being banned, or refuses to pay for product shipped correctly and free of damage that they still want to keep instead of following 3. & 4. of our refund policy. Trust us, it's all happened before.

    • You may not use any device, software or routine to interfere or attempt to interfere with the proper working of this Site or any portion thereof and you may not take any action that imposes an unreasonable or disproportionately large burden on this Site, as determined by A Nurse's Tea in its sole discretion.

    • Any modification of the Materials or use of the Materials for any other purpose is a violation of A Nurse's Tea's copyright and other proprietary rights. The use of any such Materials on any other service or computer network without A Nurse's Tea's written consent is strictly prohibited. Your use of the Trademarks in any manner other than as authorized in these Terms & Conditions, or as authorized in writing by A Nurse's Tea, is strictly prohibited. All rights not expressly granted to you are reserved by A Nurse's Tea.

  • Evolving Terms & Conditions:

    • We may change or revise these Terms & Conditions, the Code of Conduct, and Forum Conduct from time to time by updating their respective pages, so please visit them each time you use our site to keep up to date with the current terms regarding your use of our Site. To the fullest extent permitted under all applicable laws, rules, regulations and requirements (collectively, "Applicable Laws"), your use of our Site reaffirms your continuing agreement to the then-current Terms & Conditions.

  • User Code of Conduct

    • In using or accessing this Site, you agree, without limitation:

      • not to use meta tags or any other "hidden text" utilizing any Trademark without A Nurse's Tea's express prior written consent;

      • not to "deeplink" to this Site without A Nurse's Tea's express prior written consent;

      • not to create or use a false identity on this Site;

      • not to collect or store personal data about others;

      • not to attempt to obtain unauthorized access to this Site or portions of this Site that are restricted from general access;

      • not to transmit any material that is false and/or defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person's privacy, violates any third party proprietary rights, or is in violation of any law or regulation;

      • not to post any copyrighted, trademarked, or other proprietary material unless you own the copyright, trademark, right of publicity and/or other applicable proprietary rights, or you have all necessary rights to do so and to grant A Nurse's Tea the rights set forth in these Terms & Conditions;

      • not to use the features of this Site at any web site other than a merchant, retail or social networking web site as permitted under these Terms & Conditions. Such restricted web sites shall include, without limitation, blogs and other online publications; and

      • not to use this Site in breach of any Third Party Site's terms and conditions.

    • In addition, you agree that you will comply with all Applicable Laws that relate to your use of or activities in connection with this Site. You also agree to act consistent with the requirements set forth in these Terms & Conditions and the requirements of A Nurse's Tea.

    • You agree to immediately notify A Nurse's Tea if you suspect illegal, fraudulent or abusive activity, or any activity in violation of these Terms & Conditions, including any unauthorized access to your Account. If you so notify A Nurse's Tea, or we otherwise suspect such activity, you agree to cooperate with A Nurse's Tea in any investigation and to use any prevention measures we prescribe.

  • User Submissions:

    • Certain portions of the Site may permit you to submit, post, transmit or upload content created by you ("User Submissions"), which may include, without limitation, photographs, information, text, images, graphics, video, comments, suggestions, ideas (including product and advertising ideas), posts to blogs/ social networks/ discussion forums, and communications with other Site users.

    • In connection with User Submissions, you agree that you will not submit User Submissions that:

      • include material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights (including, without limitation, trademark, privacy and publicity rights) unless you are the owner of such rights or have express permission from their rightful owner to post the material and to grant the rights granted herein;

      • include any material that by itself, or by its use as permitted in these Terms & Conditions, infringes upon, misappropriates or violates the rights of any person or entity or any Applicable Laws;

      • are unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law or is otherwise inappropriate;

      • contain advertisements or solicitations of any funds, goods or services;

      • is a communication by a user impersonating another user;

      • contains personal information, such as messages which identify telephone numbers, social security numbers, account numbers or addresses; or

      • could be considered bulk unsolicited communications.

    • By submitting, transmitting, posting, uploading, modifying or otherwise providing any User Submissions to A Nurse's Tea through this Site, whether solicited or unsolicited, you agree that you are granting A Nurse's Tea a royalty-free, fully paid, non-exclusive, irrevocable, perpetual, unrestricted, worldwide, sub-licensable, transferable license to use, reproduce, broadcast, publish, transmit, perform, display, create derivative works from, translate, adapt, modify, distribute, exhibit, disseminate and otherwise exploit (collectively, "Use") such User Submissions for any purpose, including, without limitation, advertising, marketing and promotional purposes, in any media, now or hereafter known, even if these Terms & Conditions are later modified or terminated.

    • No credit, approval or compensation is due to you for any such Use of User Submissions you may submit. The Licensed Parties also have the right, but not the obligation, to Use your username (and real name, image, likeness, caption, location information or other identifying information, if provided in connection with User Submissions), in connection with broadcast, print, online or any other Use of your User Submissions. All User Submissions become the unrestricted licensed property of the Licensed Parties.

    • By submitting, posting, transmitting or uploading User Submissions through or to the Site, you authorize the Licensed Parties to make copies thereof and retain such User Submissions and copies as the Licensed Parties deem necessary to facilitate the Use of the User Submission.

    • You represent and warrant that neither the User Submissions, nor the Use of the User Submissions as permitted in these Terms & Conditions, will infringe upon, misappropriate or violate the intellectual property, privacy, publicity, statutory, contractual, personal or other rights of any person or entity or any Applicable Laws, and that you have obtained all necessary rights for the grants to the Licensed Parties, including without limitation, written releases of all rights of privacy and publicity from all individuals included in any way in the User Submissions. All User Submissions must comply with the User Code of Conduct set forth above.

    • Although the Licensed Parties are under no obligation to review or monitor User Submissions, the Licensed Parties reserve the absolute right to do so in their sole discretion. In addition, the Licensed Parties reserve the right to alter, edit, refuse to post or remove any User Submissions, in whole or in part, for any reason or for no reason. A Nurse's Tea also reserves the right to terminate your Account if you violate any of these Terms of Use or our policies, as determined in our sole discretion. You agree that A Nurse's Tea does not have any obligation to use or respond to any User Submissions. The Licensed Parties have no control over whether such User Submissions are of a nature that you might find offensive, distasteful or otherwise unacceptable and, accordingly, the Licensed Parties expressly disclaim any responsibility for User Submissions.

    • If you are aware of any User Submissions on this Site which violate these Terms & Conditions, please contact us via our Contact page (email, form, call, or written letter). Please provide as much detail as possible, including a copy of the underlying material, the location where A Nurse's Tea may find it, and the reason such User Submissions should be removed. Please note that filing a complaint will not guarantee its removal; A Nurse's Tea will only remove User Submissions if A Nurse's Tea believes the measure is necessary, in our sole discretion. To the extent any notice is based on an alleged copyright violation, please follow the instructions set forth in the section below entitled "Copyright Agent." In no event does A Nurse's Tea assume any liability for failing to either monitor or remove specific User Submissions.

    • A Nurse's Tea will fully cooperate with any law enforcement authorities or court order requesting or directing A Nurse's Tea to disclose the identity of anyone posting User Submissions that violate these Terms of Use or any law or regulation. A Nurse's Tea may also disclose such information if it has a good faith belief that such disclosure is reasonably necessary to protect the rights, property, or personal safety of A Nurse's Tea, its customers or the public.

  • Terms of Sale

    • A Nurse's Tea reserves the right to revise the pricing of its products at any time and without advance notice.

    • Products will be shipped according to the standard methods of shipping that A Nurse's Tea has in place at the time of ordering.  Please see A Nurse's Tea's shipping information found on home page for more information.

    • When a product is received in a damaged condition it should be reported promptly to A Nurse's Tea by calling 855-4ESSIAC (855-437-7422).

    • When a discrepancy exists between the quantity or items ordered and the quantity or items received, then A Nurse's Tea must be notified within 30 business days of receipt of the shipment.

    • When a customer places an order online and then subsequently refuses to accept delivery of the order for reasons that are attributable to customer error, the customer will be assessed the cost of full shipping charges.

    • All returns must be pre-approved by A Nurse's Tea and received within 30 business days of authorization of the return. Please call A Nurse's Tea at 855-4ESSIAC.

    • All returned products should have a copy of the original invoice with a note explaining again the reason for the return.

    • A Nurse's Tea must receive a returned product before a product credit will be issued.

    • The customer is responsible for shipping costs on returned products unless shipping costs are waived as per the scenarios described in our Return Policy.

  • Internet Reseller Policy

    • A Nurse's Tea has unilaterally adopted an Internet Reseller Policy (Internet Policy), which shall apply to all U.S. internet resellers, collectively, (“Resellers”) who resell A Nurse's Tea products to end users via the Internet. A Nurse's Tea is adopting this policy to help preserve its standard for providing resellers with high quality products and sales and technical support.

    • Any reseller must fill out and submit to A Nurse's Tea through email (anursestea@gmail.com a copy of A Nurse's Tea Reseller Policy. It must be signed by the reseller in control of their website, and whose personal account is registered through A Nurse's Tea before placing A Nurse's Tea products, logos, pictures or trademarks on their website. A copy must be signed and submitted to A Nurse's Tea. Internet Reseller Policy is available on www.anursestea.com. A Nurse's Tea may suspend any account who does not comply or who has not submitted this signed policy, until compliance is satisfactory.

    • One aspect of meeting A Nurse's Tea's standard is to sell such products online at no less than 10% below the suggested retail prices set by A Nurse's Tea. Any advertisements, discounts, rewards programs, coupons, special offers, sales, promotions, etc. must explicitly state “Not valid on www.anursestea.com” and products must check-out at no less than 10% below suggested retail pricing.

    • This internet policy does not apply to resellers who sell A Nurse's Tea's products via a web page that is protected by a customer account logins or passwords. For example, private patients being treated by the practitioner may be given a private patient code to be entered upon checkout to replicate the discount provided to patients in the practitioners’ office. This code must not be provided to any customer via broadcast email, must not be shown on the website and must not be made available to anyone other than the practitioners’ private patients. Reference upon checkout may only be as “patient code”; i.e. any word implying a discount, special, sale, coupon, etc. may not be used.

    • A Nurse's Tea reserves the right not to sell or supply any products to any reseller that is affiliated with a web site that violates this Internet Policy. Any Reseller reference or inference at all to discounts, price reductions, special call-in pricing, coupons, and price matching policies or another special promotion or offer on A Nurse's Tea's products will be deemed to be violations of this policy and grounds for immediate suspension of affiliated Reseller’s account(s).

    • The Internet Reseller Policy applies to the advertised price of A Nurse's Tea’s products in any and all media, including, but not limited to: flyers, posters, coupons, emails, inserts, newspapers, magazines, catalogs, mail order catalogs, Internet, and television.

    • A Nurse's Tea reserves the right not to sell its products to any customer who is affiliated with a website that violates its Internet Reseller Policy. A violation of A Nurse's Tea’s Internet Reseller Policy is grounds for suspension of a customer's account.

    • If a practitioner fails to comply with the Internet Reseller Policy, a representative of A Nurse's Tea shall notify them via phone, letter or email of the violation and may place the practitioner's account on hold until the online pricing has come into compliance. If a practitioner repeats a violation of the above conditions, A Nurse's Tea reserves the right to immediately revoke the practitioner's wholesale purchasing privileges and, without notice, take any additional action it deems necessary against the practitioner or distributor that violates this policy.

    • The Internet Reseller Policy does not apply to advertising direct from the practitioner's office to their private patient base.

  • Affiliate Marketing Programs

    • A Nurse's Tea’s products cannot be offered as part of an Affiliate Marketing Program. A Nurse's Tea uses the definition of an Internet-based Affiliate Marketing program that can be found on http://en.wikipedia.org/wiki/Affiliate_Program.

  • Restrictions on Use

    • You are permitted access to this site for personal, non-commercial purposes only and you may use this site for purposes expressly permitted by this site. You may not use this site for any other purpose, including any commercial purpose, without A Nurse's Tea's express prior written consent. For example, you may not (and may not authorize any other party to) (i) co-brand this site, or (ii) frame this site, or (iii) hyper-link to this site, without the express prior written permission of an authorized representative of A Nurse's Tea. For purposes of these Terms and Conditions Policy, "co-branding" means to display a name, logo, trademark, or other means of attribution or identification of any party in such a manner as is reasonably likely to give a user the impression that such other party has the right to display, publish, or distribute this site or content accessible within this site. You agree to cooperate with A Nurse's Tea in causing any unauthorized co-branding, framing or hyper-linking immediately to cease.

  • Use of A Nurse's Tea’s Trademarks on the Internet

    • Images and likenesses of A Nurse's Tea’s trademarks and trade dress (including pictures of bottles or dry packet containers bearing A Nurse's Tea's labeling) can be requested from A Nurse's Tea from this website by professional customers who have opened a A Nurse's Tea customer account.

    • A customer does not have the right to affix any A Nurse's Tea trademark to any product or other material that is not a A Nurse's Tea product.

    • A customer agrees to use the symbols TM and ®, as appropriate, when displaying A Nurse's Tea’s trademarked names or products, as an indication of A Nurse's Tea’s ownership of its trademarks. The use of a A Nurse's Tea’s trademark does not give a customer any ownership right, title, or interest, express or implied, in the trademark. Logo’s or labeling may change without notification, check regularly with A Nurse's Tea to ensure complete compliance.

    • A customer's use of A Nurse's Tea’s trademarks must be accompanied by a statement substantially as follows: "A Nurse's Tea's trademarks are used with permission."

    • A customer must include on all website pages that reflect A Nurse's Tea’s products a statement substantially as follows: "This website is not owned or operated by A Nurse's Tea and does not guarantee that the products resold on this website have been stored in appropriate conditions to maintain shelf-life."

    • A customer must not use A Nurse's Tea’s trademarks except in the form, context, and location that are acceptable to A Nurse's Tea. A Nurse's Tea will periodically review a customer's website and reserves the right to demand that a customer make changes to its website regarding the use of intellectual property owned or controlled by A Nurse's Tea, even if A Nurse's Tea has previously approved or accepted the customer's website or the material displayed thereon.

    • A customer must not use any A Nurse's Tea product name or trademark as part of a URL (Universal Resource Locator), secondary level domain name, metatag, key word, or file name.

  • Disease Claims

    • In an effort to protect its customers and A Nurse's Tea from potential legal liability due to the regulatory requirements of the U.S. Food and Drug Administration and the U.S. Federal Trade Commission regarding disease claims that could be associated with its products, A Nurse's Tea products may not be displayed or mentioned within two clicks of any disease claim.

    • A Nurse's Tea will periodically review a customer's website and reserves the right to demand a customer make changes to its website regarding any disease claim regarding a A Nurse's Tea product, even if A Nurse's Tea has previously approved or accepted the customer's website or the material displayed thereon.

    • A Nurse's Tea reserves the right to demand a customer make changes to its website to the extent a customer is making statements about A Nurse's Tea products in any manner that violates regulations implemented by the U.S. Food and Drug Administration, the U.S. Federal Trade Commission, or the regulations implemented by any other federal or state agency.

  • Violations of Policy

    • Every effort will be made to contact any violator of A Nurse's Tea’s Internet Policy through phone, email or letter. Any A Nurse's Tea account or an account through a distributor may be suspended at any time without prior notification if A Nurse's Tea feels there has been a violation of a policy. You may contact A Nurse's Tea and ask for notification as to why your account was suspended.

    • A customer who corrects the violation to bring it into compliance with this policy should promptly notify A Nurse's Tea. A Nurse's Tea One will review the website and if A Nurse's Tea determines the website has been brought into compliance with this policy, the customer's account will be reactivated. A Nurse's Tea has adopted a zero-tolerance approach to this policy. Customers acknowledge that upon any subsequent breach of any provision of this policy, A Nurse's Tea may terminate the customer's account without notice.

  • Copyright / Trademark / Logo

    • The A Nurse's Tea logo can be used only in the special form supplied by A Nurse's Tea for use on the Internet; neither the file name nor the name of the image may be changed or modified from the original form supplied by A Nurse's Tea. Reseller agrees to use the symbols ™ and ®, as appropriate, when displaying the Trademarks, which is intended to indicate A Nurse's Tea's ownership of the trademarks and shall not be construed as a claim to ownership by reseller. Reseller’s use of the Trademarks must be accompanied by a statement substantially as follows: “[Insert the trademark(s)] are trademarks of A Nurse's Tea, LLC and are used with permission.” The Trademarks are solely and exclusively the property of A Nurse's Tea. Reseller shall not have any ownership right, title, or interest, express or implied, in the Trademarks. Reseller shall not use the Trademarks except in a form, context and location that are acceptable to A Nurse's Tea. No other statements may be affiliated with use of the A Nurse's Tea’s logo.

    • Except where otherwise indicated, all materials presented on this website are the copyrighted property of A Nurse's Tea. The A Nurse's Tea logo and the names of various products offered by A Nurse's Tea are trademarks of A Nurse's Tea.

    • Permission is hereby granted to use, copy, and distribute the materials presented on this website without alteration for non-commercial purposes only; provided, however, that all copyright, trademark, and other proprietary notices appear in all copies in the same manner as the original. All other uses are prohibited.

    • A Nurse's Tea may review Reseller’s Web site at any time and reserves the right to require Reseller to make changes to it based upon use of any intellectual property owned or controlled by A Nurse's Tea, even if A Nurse's Tea has previously approved or accepted Reseller’s web site or the material displayed thereon. Reseller may not use A Nurse's Tea product names, trademarks or copyrights as a part of a URL (Universal Resource Locator), secondary level domain name, meta-tags, key works, or file names.

    • A Nurse's Tea reserves all rights to claim monetary damages for the misuse of its trade names, marks, and or any liability for claims made that misrepresent it or its products.
